REFUND, CANCELLATION & PAUSE POLICY

This Refund, Cancellation, and Pause Policy ("Policy") forms part of the Terms of Service governing your use of the EmbedMyReviews ("EMR") platform. By creating an account, subscribing, or continuing to use the Service, you agree to the following terms.

1. SUBSCRIPTION BILLING

1.1. All EMR subscriptions operate on a prepaid, recurring monthly basis.

1.2. Subscription fees cover access to the platform for the upcoming billing period, not usage.

1.3. Renewals are processed automatically using the payment method on file until a cancellation request is submitted by the account holder.

2. CUSTOMER RESPONSIBILITY FOR MANAGING BILLING

2.1. You are solely responsible for managing your subscription, including cancellations and pauses.

2.2. All billing actions must be performed through the platform by navigating to: Account & Billing → Billing

2.3. Support inquiries, emails, messages, or verbal comments do not constitute a cancellation request.

3. CANCELLATION POLICY

3.1. To cancel, you must use the Cancel Subscription button located in the Billing section.

3.2. Cancellation takes effect at the end of the current billing period.

3.3. No further charges will occur once cancellation is submitted.

3.4. You will retain full access to your account and all features until the billing period ends.

3.5. EMR does not issue prorated refunds for unused time after a renewal has occurred.

3.6. Upon cancellation, your account, data, integrations, and white-label configurations may be scheduled for deletion at any time.

4. PAUSE POLICY

4.1. Pausing your subscription is an optional feature for agencies who need temporary relief without losing their existing pricing plan.

4.2. When pausing, the system clearly displays that:

• Billing stops during the pause period
• All data remains intact
• Your grandfathered pricing is preserved
• Billing resumes automatically when the selected pause period ends

4.3. Pausing is not cancellation.

4.4. If you do not wish to be billed when the pause ends, you must submit a cancellation before the pause expiration date.

4.5. Renewals triggered at the end of a pause are valid and non-refundable.

5. GRANDFATHERED / LOCKED-IN PRICING

5.1. Agencies who cancel their subscription lose all locked-in or grandfathered pricing.

5.2. Rejoining the platform after cancelling will require subscribing at the current public pricing, which may be higher.

5.3. Pausing preserves locked-in pricing, cancellation does not.

6. REFUND POLICY

6.1. All subscription payments are final and non-refundable.

6.2. EMR does not provide refunds or credits for:

• Partial months
• Unused portions of service
• Failure to cancel before renewal
• Failure to understand or read the pause/cancel options
• Lack of use of the platform

6.3. Refunds will not be issued for charges that occurred prior to a cancellation request.

6.4. Disputing legitimate charges may result in permanent account termination and loss of grandfathered pricing.

7. ACCOUNT DELETION UPON CANCELLATION

7.1. EMR reserves the right to remove:

• Agency accounts
• Client/location accounts
• White-label assets
• SSL certificates
• Domains pointing to EMR servers
• Associated databases and data storage

7.2. Deletion may occur immediately or at any time after the cancellation takes effect.

8. ACCESS AFTER CANCELLATION

8.1. You will retain full access until the paid billing cycle concludes.

8.2. After that date, access is completely removed unless a new subscription is purchased.

9. ACCEPTANCE

By subscribing, pausing, or continuing to use EMR, you acknowledge and agree that:

• Pausing is not cancellation
• Renewals at the end of pauses are valid
• Charges are non-refundable
• You must cancel within the Billing section to stop future renewals
• EMR is not responsible for misuse or misunderstanding of these terms

10. DISPUTE RESOLUTION

10.1. Before initiating a chargeback or payment dispute with your bank or payment provider, you agree to first contact EMR support at [email protected] to attempt resolution.

10.2. Filing a chargeback for a legitimate charge (including but not limited to: automatic renewals, post-pause renewals, or charges for services rendered) constitutes a breach of this agreement.

10.3. In the event of a disputed charge, EMR reserves the right to:

• Immediately suspend or terminate your account
• Pursue collection of any amounts owed
• Report the dispute to credit bureaus or collection agencies
• Recover costs associated with disputing the chargeback, including administrative fees

10.4. You acknowledge that all billing and transaction records, including confirmation emails, account activity logs, and service usage data, may be used as evidence in any dispute proceedings.

11. ELECTRONIC AGREEMENT

11.1. By completing a subscription purchase, you electronically sign and agree to be bound by this Policy.

11.2. Your electronic acceptance has the same legal force as a handwritten signature.

11.3. You confirm that you have read, understood, and agree to all terms outlined in this Policy before completing your purchase.

11.4. A link to this Policy is displayed during the checkout process and in your account billing section.
